These cases were consolidated for argument and involve essentially the same facts and issues. The petitioner Marvin G. Fredenberg is a prisoner in the federal correctional institution at Sandstone, Minnesota, under a minimum sentence expiring on January 16, 1964, having been sentenced on or about January 23, 1962. Prior thereto complaints and warrants for his arrest were on file in the counties of Shawano, Dane and Columbia in Wisconsin, charging him with forgery under sec. 943.38 Stats. The complaint and warrant were issued on October 19, 1961, by the Dane county district attorneys office but the record does not give the dates of the other complaints and warrants. Detainers were filed with the warden of the federal correctional institution at Sandstone. As a result of a previous application to this court for a writ of mandamus the petitioner was brought back to Shawano county where he pleaded guilty to charges of forgery and was convicted on February 18, 1963. Prior to filing the instant petitions in this court for writs of mandamus the petitioner had applied to what he called the district court of Dane county to be returned for trial of the charges pending against him in that court. The respondent Byrne, district attorney for Dane county, refused to take any action to have petitioner brought to trial. Upon the petitioners petitions in this court, alternative writs of mandamus were issued on March 25, 1963, requiring the respondents to take action to obtain the return of the petitioner to Wisconsin for trial of the respective charges, or in the alternative to apply to the proper court for the dismissal of the charges or to show cause why neither should be done. The respondents chose the last alternative. The petitioner being indigent, Donald S. Eisenberg was appointed to represent him and oral arguments were had and briefs filed.
